General Conditions of Services
Appointment Scheduling
Appointments can be scheduled through our customer service or online. For customer service orders, we will contact the appropriate person. Appointments are assigned time slots, and a confirmation email with an approximate time will be sent to the email address(es) provided in the order. If conditions allow, the system may offer a guaranteed time.
Safety During Appointments
The person receiving the photographer is responsible for their safety. If the property is tenanted, it is preferable and strongly recommended that the broker and/or owner be present, especially during winter. Please ensure that the driveway, steps, and a path to the yard are clear. Apply salt, rock dust, or any other de-icing product to minimize ice patches from the street to your driveway. You may be held responsible for any incidents involving falls of visitors, brokers, or the photographer.
Delay Policy
In the event of a delay or absence of the designated person without prior notification to BrokerLens, exceeding fifteen minutes, the photographer will proceed with taking exterior photos and then depart. Consequently, you will be charged for an outdoor photo shoot.

Processing Times
A regular HDR photoshoot should last a maximum of forty-five minutes. Any shoot exceeding one hour may result in additional fees. The final version of the photos will be delivered the following day.
For 3D or video sessions, additional time will be allocated to the photographer based on the size of the property. Photos included with these sessions will be delivered the next business day following the appointment. For 3D or video content, a processing time of twenty-four to forty-eight working hours following the appointment is expected.
For aerial photos or videos, the processing time is the same as for regular photos, with delivery the next day.
Hosting Policy
Photos taken for registration purposes are typically used for an average duration of six months. BrokerLens ensures that these photos are retained for a period of twelve months. After this period, the photos may no longer be available. We strongly recommend downloading the photos to your computer upon receipt.
Virtual models are also retained for a period of tree months.
Terms & Conditions
These Terms and Conditions govern the provision of real estate photography services by Brokerlens (“Photographer”) to the client (“Client”). By booking our services, the Client agrees to these terms.
2. Copyright and Ownership

Photographer’s Rights: Under Bill C-11, the Photographer retains full copyright and moral rights to all images produced. This includes images taken for commissioned work.

Usage License: The Client is granted a non-exclusive, non-transferable license to use the images for marketing and promotional purposes related to the property. This license does not include the right to sell or distribute the images to third parties without the Photographer’s written consent.

Attribution: The Client agrees to credit the Photographer whenever the images are used in public or online platforms (IE: Facebook, Instagram).
3. Scope of Services

Services Provided: The Photographer will provide professional real estate photography services, including but not limited to interior and exterior photos, virtual tours, and aerial photography.

Deliverables: Edited images will be delivered within 24 hours of the shoot unless otherwise agreed upon.
4. Payment Terms

Fees: The Client agrees to pay the fees as outlined in the invoice provided by the Photographer. A deposit may be required at the time of booking.

Late Payments: Late payments may incur additional charges. The Photographer reserves the right to withhold delivery of images until full payment is received.
5. Cancellation and Rescheduling

Cancellation: Cancellations made less than 24 hours before the scheduled shoot may incur a cancellation fee (65$).

Rescheduling: The Client may reschedule the shoot without penalty if notice is given at least 24 hours in advance and is agreed upon by both parties.
6. Liability

Property Damage: The Photographer is not responsible for any damage to the property during the shoot unless caused by gross negligence.

Image Quality: The Photographer will make every effort to ensure high-quality images but does not guarantee specific results due to varying property conditions.
7. Privacy and Confidentiality

Client Information: The Photographer will keep all client information confidential and will not share it with third parties without the Client’s consent.

Property Access: The Client must ensure that the property is accessible at the agreed-upon time and that all necessary permissions have been obtained.
8. Governing Law
These terms and conditions are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
